KVSH Radio reports that the Cherry County Board of adjustment voted Thursday to uphold the complaint filed with Cherry County about the Kilgore Wind project. Thursday afternoon the board upheld the letter from County Zoning Administrator Jane Stolzenberg that reported Bluestem Sandhills had not met all the conditions of the permit process. Even though County attorney Eric Scott disagreed with some of the points stated in her letter.
Mrs. Stolzenberg had not requested information from Bluestem Sandhills during her investigation of the complaint. This may open the door for yet another lawsuit, this time from the developer. Previous suits were filed by anti-wind factions. These lawsuits were all thrown out by the courts, some by the Nebraska Supreme Court. The lawsuits cost the county taxpayers over $150,000 in outside legal fees. Stayed tuned to KVSH for more details.
